Senator Carlucci Supports Warning Labels For Lead-Based Holiday Decorations

Senator David Carlucci (D-Rockland/Westchester) has announced legislation that would require a warning label be attached to any holiday decorations containing lead sold or delivered for sale in New York.

Carlucci cited a recent study that found 85 percent of artificial Christmas trees made in China sold in the United States tested positive for PVC (polyvinyl chloride) plastics, which are known to contain lead. Other holiday decorations such artificial wreaths, stockings and figurines also carry the risk of containing lead.

As we enter the holiday season, Senator Carlucci said that he wants everyone, especially parents of small children, to be aware of the presence of these harmful chemicals in decorations. Senator Carlucci’s bill would require a warning label be put on any holiday decoration containing lead that would read “WARNING: CONTAINS LEAD. MAY BE HARMFUL. MAY GENERATE DUST CONTAINING LEAD.”

The bill also contains a provision allowing for a civil penalty of $1,000 for every violation.
