DA REPORT 6/22/14

DWI
Maria Cooke, age 48, residing at, 76 Ash Street in Bardonia, was indicted on June 13, 2014 by a Rockland County Grand Jury for the crime of driving while intoxicated as a felony. District Attorney Thomas P. Zugibe stated that on or about October 30, 2013 at approximately 1:14 a.m., the defendant struck a vehicle while driving on Ludvigh Road in the Town of Clarkstown. The officer observed the defendant to be in intoxicated state and placed the defendant under arrest. The defendant had a previous DWI in the Town of Stony Point in 2009.

CRIMINAL POSSESSION OF A WEAPON
Andy Negri, age 27, residing at 605 Maplewood Gardens, Nanuet, NY, was indicted on June 13, 2014 by a Rockland County Grand Jury for the crimes of criminal possession of a weapon in the second and third degrees. District Attorney Thomas P. Zugibe stated that on or about February 15, 2014 at approximately 3:13 a.m., the defendant was a passenger in a vehicle driven in the Village of Spring Valley.  The vehicle was stopped for various vehicle and traffic violations. A search of the defendant revealed a small plastic bag of marihuana, a magazine containing five live rounds of ammunition and a defaced semi-automatic handgun.

DWI
Colette D. McCready, age 42, residing at 85 South Summit St., Bergenfield, NJ, was indicted on June 13, 2014 by a Rockland County Grand Jury for the crime of driving while intoxicated as a felony. District Attorney Thomas P. Zugibe stated that on or about January 17 at approximately 6:22 p.m., the defendant was stopped for various vehicle and traffic violations. The officer observed the defendant to be in an intoxicated condition. The defendant had slurred speech, glassy eyes and an odor of alcoholic beverage. The defendant failed various sobriety tests.  The defendant had a previous DWI in Queens County in 2009.

VEHICULAR ASSAULT & DWI

Cheryl Vespry, age 46, residing at 721 N. Liberty Drive, Tomkins Cove, NY, was indicted on June 13, 2014 by a Rockland County Grand Jury for the crimes of vehicular assault in the second degree and driving while intoxicated. District Attorney Thomas P. Zugibe stated that on or about May 25, 2013 at approximately 6:55 p.m. the defendant was driving on North Liberty Drive in the Town of Stony Point, struck another vehicle. The defendant was in an intoxicated state. The other vehicle’s passenger was seriously injured as a result of the accident.

ATTEMPTED ASSAULT
Justin Rivera, age 24, residing at 28 Middle Street, Haverstraw, was sentenced June 17, 2014, before Rockland County Court Judge William K. Nelson to a state prison term of one and a half to three years after pleading guilty to attempted assault in the second degree. District Attorney, Thomas P. Zugibe stated that on or about September 3, 2013 at approximately 3 pm, the defendant struck a 74-year-old victim with a plastic lawn chair during an argument. The victim suffered a fractured clavicle bone in her left shoulder.

ATTEMPTED BURGLARY
Arturo Vicente-Romero, age 55, residing at 12 South Myrtle Avenue, Spring Valley, NY, was sentenced June 17, 2014, before Rockland County Court Judge William K. Nelson to a state prison term of two years and two years post release supervision after pleading guilty to attempted burglary in the second degree. District Attorney, Thomas P. Zugibe stated that on or about June 27, 2013 at approximately 7:45 p.m., the defendant forced himself through the victim’s door. He grabbed and choked her while demanded money for Chinese food. The victim escaped the defendant’s grasp and told him that she was calling the police and he thereafter left the apartment.

ATTEMPTED BURGLARY
David Tyson, age 35, residing at 541 Bronx River, Yonkers, NY, was sentenced June 17, 2014, before Rockland County Court Judge William K. Nelson to a state prison term of eight years and five years post release supervision after pleading guilty to attempted burglary in the first degree. District Attorney, Thomas P. Zugibe stated that on or about June 16, 2013 at approximately 2:30 p.m., the defendant unlawfully entered a dwelling located on Broadway in the Village of Haverstraw. While inside the dwelling, the defendant caused physical injury to another individual whom was not a participant in the crime. The defendant threatened the individual with a tire iron.
