DA REPORT 6/1/14

ATTEMPTED CRIMINAL POSSESSION OF CONTROLLED SUBSTANCE
Lyle Johnson, age 48, of Utica, NY, was sentenced by the Honorable Charles Apotheker, County Court Judge on May 21, 2014 to one year in State Prison and one year post release supervision after pleading guilty to attempted criminal possession of controlled substance in the third degree. District Attorney, Thomas P. Zugibe stated that on or about December 2, 2013, subsequent to being stopped on I-87 Northbound in the Town of Clarkstown for a vehicle and traffic law violation, the defendant was found to be in possession of approximately 43.6 grams of heroin.

GRAND LARCENY
Lindsay Skerry, age 27, residing at 50 Halgren Crescent, Haverstraw, New York was sentenced by the Honorable Charles Apotheker, County Court Judge on May 21, 2014 to 1 1/2 – 3 years in State Prison after pleading guilty to grand larceny in the fourth degree, as a second felony offender. District Attorney, Thomas P. Zugibe stated that on or about December 3, 2013 at approximately 3:50 p.m., at the Macy’s store located at the Palisades Center Mall in the Town of Clarkstown, the defendant stole 14 pieces of jewelry valued at $1,300.

BURGLARY & ASSAULT
Luis Cedeno, age 22, residing at 41 Parkway Trailer Court, Pomona, NY, and Christopher Williams, age 23, residing at 21 Elm Street, Garnerville, NY, the defendants were indicted on May 14, 2014 by a Rockland County Grand Jury for the crimes of burglary in the first degree and assault in the second degree. District Attorney Thomas P. Zugibe stated that on or about April 28, 2014, the defendants broke into a residence located in Jones Point, New York. The defendants were found in the home by the homeowners and defendant Cedena caused physical injury to one homeowner. Jewelry was stolen from the home.

UNAUTHORIZED PRACTICE OF A PROFESSION & PROSTITUTION
Gyelim Choi, age 40, residing at 4265 Colton Street, Flushing, NY, was indicted on May 21, 2014 by a Rockland County Grand Jury for the crimes of unauthorized practice of a profession and prostitution. District Attorney Thomas P. Zugibe stated that on or about November 7, 2013, the defendant performed a massage on an undercover officer for a fee while not being licensed by New York State. The defendant then offered to perform a sexual act for a fee.

CRIMINAL POSSESSION OF CONTROLLED SUBSTANCE & UNLAWFUL POSSESSION OF MARIJUANA
Orrel Evans, age 46, residing at 449 Livingston Avenue, Albany, NY, was indicted on May 21, 2014 by a Rockland County Grand Jury for the crimes of criminal possession of a controlled substance in the third and fourth degrees and unlawful possession of marijuana. District Attorney Thomas P. Zugibe stated that on or about January 4, 2014, the defendant was operating a vehicle in excess of the posted speed limit while on the NYS Thruway in the Village of Hillburn. After a search of the vehicle, the defendant was found to be possession of approximately 1/8 ounce of cocaine and marijuana.

UNAUTHORIZED PRACTICE OF A PROFESSION & PROSTITUTION
Yoengae Kim, age 45, residing at 71 E. Palisades Park, NJ, was indicted on May 21, 2014 by a Rockland County Grand Jury for the crimes of unauthorized practice of a profession and prostitution. District Attorney Thomas P. Zugibe stated that on or about November 26, 2013, the defendant performed a massage on an undercover officer for a fee while not being licensed by New York State. The defendant then offered to perform a sexual act for a fee.

ASSAULT
Mario Mena, age 23, residing at 1 Francis Place, Nyack, NY, was indicted on May 14, 2014 by a Rockland County Grand Jury for the crime of assault in the second degree. District Attorney Thomas P. Zugibe stated that on or about September 28, 2013 at approximately 1:30 am, the defendant punched the victim twice in the jaw during an argument outside a pizza establishment in the Village of Nyack. The victim was transported to a local hospital where it was determined that he had a broken jaw causing his jaw to be wired for a period of time.

CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE
Clifton Pierre, age 30, residing at 9204 Overhill Drive, Pomona, NY, was indicted on May 21, 2014 by a Rockland County Grand Jury for the crimes of criminal possession of a controlled substance in the third and fourth degrees. District Attorney Thomas P. Zugibe stated that on or about January 16, 2014, the defendant was operating an unregistered and uninsured vehicle on Thiells Mt. Ivy Road in Pomona. The defendant’s license was also revoked. After a search of the vehicle, the defendant was found to be possession of approximately 1/8 ounce of cocaine.

RAPE & ENDANGERING THE WELFARE OF A CHILD
Emmanuel Rodriguez-Cabrera, age 21, residing at 19 Lincoln Avenue, Haverstraw, NY, was indicted on May 21, 2014 by a Rockland County Grand Jury for the crimes of rape in the first degree and endangering the welfare of a child. District Attorney Thomas P. Zugibe stated that on or about April 15, 2013, the defendant met an 11 year old victim online and had sexual intercourse with the under aged victim at his residence.

GRAND LARCENY
Erica Sanford, age 36, residing at 235 Park Terrace, Monroe, NY, was indicted on May 23, 2014 by a Rockland County Grand Jury for the crime of grand larceny in the second degree. District Attorney Thomas P. Zugibe stated that on or about and between May 31, 2010 and September 30, 2012, while employed as the Office Manager and Bookkeeper for Tri-State Carpet Connections in Tappan, NY stole approximately $50,000 from her employer. The defendant transferred money to various personal credit cards and bank accounts.
