DA REPORT 12/30/13

BURGLARY
James Anis, age 25, residing at 20 Sharp Street, Haverstraw, NY, was sentenced December 4, 2013, before New York State Supreme Court Justice William A. Kelly to a state prison term of five years and three years post release supervision after pleading guilty to burglary in the first degree. District Attorney Thomas P. Zugibe stated that on or about March 7, 2013 at approximately 6:45 p.m., the defendant entered and remained unlawfully in the dwelling located on Rockland Lane in the Town of Ramapo. In the course of committing the crime, the defendant caused physical injury to two residents of the home and a police officer who was in the course of performing a lawful duty.

CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE, CRIMINALLY USING DRUG PARAPHERNALIA & UNLAWFUL POSSESSION OF MARIJUANA
Jamel Young, age 41, residing at 19 Main Street, Haverstraw, NY, was indicted on November 27, 2013 by a Rockland County Grand Jury for the crimes of criminal possession of a controlled substance in the third degree (two counts), criminally using drug paraphernalia (two counts) and unlawful possession of marijuana. District Attorney Thomas P. Zugibe stated that on or about November 14, 2013, while at 19 Main Street in the Village of Haverstraw the defendant was found to be in possession of approximately one and a half ounces of cocaine, numerous plastic baggies, a scale and a small amount of marijuana.

ASSAULT
Andre Beauford, age 35, residing at 53 William Street, Newburgh, NY, was indicted on December 4, 2013 by a Rockland County Grand Jury for the crime of assault in the second degree. District Attorney Thomas P. Zugibe stated that on or about June 1, 2013, the defendant while incarcerated in the Rockland County Jail, approached the victim, another inmate, and struck him repeatedly about the face with a closed fist causing serious physical injury, including facial fractures, a broken nose and bleeding. The victim was hospitalized and underwent surgery to repair his facial fractures.

CRIINAL POSSESSION OF A CONTROLLED SUBSTANCE
Beatriz Liz, age 20, residing at 26 Bridge Street #3, Garnerville, NY, was indicted on December 4, 2013 by a Rockland County Grand Jury for the crime of criminal possession of a controlled substance in the third and fourth degree. District Attorney Thomas P. Zugibe stated that on or about January 19, 2013, the defendant was a passenger in an automobile that was stopped in the Town of Haverstraw for vehicle and traffic violations. A small amount of marijuana was found in the automobile. The defendant had 55 oxycodone pills contained in a plastic bag in her possession.

GRAND LARCENY & CRIMINAL POSSESSION OF STOLEN PROPERTY
Raymond Mann, age 30, residing at 104 Lakeview Village, Spring Valley, NY, was indicted on November 15, 2013 by a Rockland County Grand Jury for the crimes of grand larceny in the fourth degree and criminal possession of stolen property in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about May 26, 2013 at approximately 2:30 p.m., the defendant stole the victim’s wallet from her pocketbook while they were both at New Street Laundry in Nyack, NY. The defendant used one of the victim’s credit cards to make purchases at an establishment in Nyack.

CRIMINAL POSSESSION OF MARIJUANA
Donald Solomon, age 54, residing at 16 Hastings Lane, Stony Point, was indicted on November 15, 2013 by a Rockland County Grand Jury for the crimes of criminal possession of marijuana in the third degree. District Attorney Thomas P. Zugibe stated that on or about May 3, 2013, a search warrant was executed at 16 Hastings Lane, Stony Point and approximately nine ounces of marijuana was found in a bedroom.

BURGLARY
Valerie Russell, age 28, of 51 Country Club Lane, Pomona, NY, was sentenced by the Honorable Charles Apotheker, County Court Judge on December 18, 2013 to one year in the Rockland County Jail after pleading guilty to burglary in the third degree. District Attorney, Thomas P. Zugibe stated that on or about February 17, 2012 at approximately 8 p.m. at Country Club Lane in the Town of Haverstraw, the defendant unlawfully entered a storage closet located in the basement of Building 5 and removed property not belonging to her with the intent to benefit herself. The property value exceeded $1,000.

AGGRAVATED UNLICENSED OPERATION
Jeffrey Bruno, age 27, of Harriman, NY, pled guilty on September 9, 2013 to aggravated unlicensed operation of a motor vehicle in the first degree. District Attorney, Thomas P. Zugibe stated that on or about February 18, 2013 at approximately 3:05 a.m. on I-87 North in the Village of Hillburn, the defendant operated a motor vehicle upon a public highway while under the influence of alcohol while his driving privileges in the State of New York were revoked. On December 16, 2013, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to 10 months in the Rockland County Jail.

ROBBERY
Tirrell Edmundson, age 21, residing in 113 Fred Hecht Drive, Spring Valley, NY, was sentenced December 17, 2013, before Rockland County Court Judge William K. Nelson to a state prison term of 10 years and five years post release supervision after pleading guilty to robbery in the first degree. District Attorney, Thomas P. Zugibe stated that the defendant, on two separate occasions, posted ads for property on Craigslist and then subsequently robbed the people whom attempted to buy the property. On September 5, 2012, the defendant met with three people who were interesting in buying a car he advertised on Facebook. The defendant, and another unknown male, robbed the three men at gunpoint. On September 11, 2012, the defendant sold a cell phone to the victim and met there after for the purpose of exchanging the cell phone for functioning one. At that time the defendant robbed the victim at gunpoint.

GRAND LARCENY
Gary Wheatley-Jackson, age 42, residing at 926 Lafayette Avenue, Brooklyn, NY, was indicted on December 27, 2013 by a Rockland County Grand Jury for the crimes of grand larceny in the fourth degree, criminal possession of stolen property in the fourth degree and criminal possession of an anti-security item. District Attorney Thomas P. Zugibe stated that on or about December 15, 2013 at approximately 5:50 p.m., the defendant took merchandise from a basket at Dicks Sporting Goods and placed them inside a booster bag. The defendant exited the store without paying and the Loss Prevention Office stopped the defendant and identified him to a Clarkstown Police Officer.

ASSAULT & CRIMINAL POSSESSION OF A WEAPON
Enrique Angulo, age 20, residing at 33 Hurd Avenue, Garnerville, NY, was indicted on December 18, 2013 by a Rockland County grand jury for the crimes of assault in the second degree and criminal possession of a weapon in the second degree (two counts). District Attorney Thomas P. Zugibe stated that on or about December 8, 2013 at approximately 4:10 a.m., the defendant struck the victim over the head with a beer bottle when he was asked to exit the bar, El Rancho Latino Bar (AKA The Big Red Tomato).

IDENTITY THEFT & CRIMINAL POSSESSION OF STOLEN PROPERTY
Edgardo Cerna, age 58, residing at 16 North Liberty Drive, Stony Point, NY, was indicted on December 27, 2013 by a Rockland County Grand Jury for the crimes of identity theft in the first degree (two counts) and criminal possession of stolen property in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about and between July 2012 and January 2013, the defendant unlawfully obtained and used two of his ill mother’s credit cards to purchase services, property and cash advances amounting to nearly $10,000.

CRIMINAL POSSESSION OF STOLEN PROPERTY
Justin Delgardio, age 29, residing at 120 Lois Drive, Pearl River, NY, was indicted on December 18, 2013 by a Rockland County Grand Jury for the crime of criminal possession of stolen property in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about July 4, 2013 at approximately 1:15 p.m., the defendant was observed by the victim entering the victim’s unoccupied car. The victim was able to remove the defendant from his car and called the police.

GRAND LARCENY
Frank Hadley, age 41, residing at 38 Fifth Street, Hillburn, NY, was indicted on December 13, 2013 by a Rockland County Grand Jury for the crime of grand larceny in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about February 19, 2013, the defendant stole $1,500 and a ring from the victim’s house while he was hired to do electrical work in the house.

CRIMINAL POSSESSION OF A FORGED INSTRUMENT
Saida Martin, age 22, residing at 241 Vernon Avenue, Brooklyn, NY, was indicted on December 27, 2013 by a Rockland County Grand Jury for the crime of criminal possession of a forged instrument in the second degree. District Attorney Thomas P. Zugibe stated that on or about July 6, 2013 at approximately 8:30 p.m. at the Palisades Center Mall, the defendant knowingly possessed 24 fraudulent credit cards.  The defendant admitted to knowing that said credit cards were in fact fraudulent.

ROBBERY
Franklyn Soto, age 20, residing at 106 Blauvelt Avenue, West Haverstraw, NY, was indicted on December 27, 2013 by a Rockland County Grand Jury for the crime of robbery in the second degree (two counts) District Attorney Thomas P. Zugibe stated that on or about July 11, 2013 at approximately 10 p.m., the defendant along with four other individuals forcibly stole the victim’s cell phone and money. The victim suffered contusions to his head, face, back and leg in which required treatment at a local hospital.
