Rockland County District Attorney Thomas P. Zugibe announced this week that 64-year-old Linwood Carter, of 157 North Road, White Plains, New York has been arrested and arraigned on one count of grand larceny in the third degree, a class “D” felony.

Carter, an insurance agent who owns and operates the Carter Insurance Agency, LLC, 22 South Madison Avenue, Spring Valley, New York, is accused of accepting premium payments from a property owner who believed he was insuring several rental units.

According to the charges, the victim paid the defendant more than $18,000 in insurance premiums between January 1, 2007, and April, 2010.

In the fall of 2010, the owner was sued for an accident at one of his rental properties. Upon contacting the insurance carrier, the victim learned he was not covered by any insurance policy, as none of the premiums had been paid by Carter. The defendant was arrested after a joint investigation by the Rockland County Special Investigations Unit and the New York State Insurance Department.

In September, 2010, Carter and his son, Kizza Carter, were arrested and charged with stealing premium payments from another corporate client. Their business, the Carter Insurance Agency, LLC, was eventually convicted of grand larceny in the third degree, a class “D” felony.

 

The defendant was arraigned today in the Village of Spring Valley Justice Court by the Honorable David Fried and and was released on his own recognizance. He is due to return to court on January 22, 2013. If convicted, the defendant faces up to seven years in prison.
