Jerome Baron, age 70, residing on Southern Boulevard in the Bronx, was convicted after a jury trial of one count of Burglary in the Second Degree, a class “C” Felony, one count of Petit Larceny, a class “A” Misdemeanor, and one count of Possession of Burglar’s Tools, a class “A” Misdemeanor On June 28, 2011, at approximately 2 p.m., a resident of the Blue Hill Commons condominium complex in Orangeburg arrived at his apartment to find two unknown men in his living room. A violent struggle ensued, during which the victim was repeatedly punched and struck with a rolled up sleeve containing silverware. During the assault, one assailant fled the unit and ran toward Western Highway. Upon hearing the commotion, a fellow Blue Hill Commons tenant called 911. The victim fought back the second attacker, and ultimately held the suspect until Orangetown police arrived. Responding officers questioned the defendant, who claimed to have mistaken the victim’s apartment for the rental office. The defendant also told police he did not know the victim. The defendant was arrested after officers determined he had broken into the apartment for the purpose of robbing it. A subsequent search of the defendant turned up two metal picks, a pair of black gloves, an unmarked silver key and a mini Leatherman. Despite a police search, the other intruder was never apprehended. It’s believed he fled with stolen cash, coins, jewelry and silverware. The defendant’s trial began on March 15, 2012. Jurors deciding the case in the courtroom of Rockland County Court Judge William A. Kelly returned a verdict of guilty on March 26 following five hours of deliberations. The defendant was ordered held at the Rockland County Jail pending sentencing on June 21, 2012. His criminal history includes prior convictions for Burglary in the First Degree, Burglary in the Second Degree and Robbery in the Second Degree, for which he served 12 years in state prison in the 1980s. He faces a possible state prison sentence of up to 15 years. This case was prosecuted by Assistant District Attorney Nabeela McLeod.

 

Richard Estrella, age 22, residing at 4 Polk Court, Stony Point, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crimes of Assault in the 1st Degree and Criminal Possession of a Weapon in the 4th Degree. District Attorney Thomas P. Zugibe stated that on or about March 4, 2012 at approximately 2 a.m. at a local bar in the Town of Haverstraw, the defendant smashed a pint glass across the victim’s face. The victim required 125 stitches to close the large laceration.

Ralph Maldonado, age 33, residing at 3 Opal Court, Pomona, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crimes of Criminal Possession of a Controlled Substance in the 5th Degree and Unlawful Possession of Marijuana. District Attorney Thomas P. Zugibe stated that on or about October 22, 2011 at approximately 3:35 a.m., the defendant was a passenger in a vehicle stopped by police for attempting to avoid a DWI checkpoint. The police found the defendant in the vehicle with marijuana on his clothes and smelled burnt marijuana in the vehicle. The defendant was searched and police found a bag of white powder believed to be cocaine. A laboratory report showed the substance was cocaine and weighed 930 milligrams. The defendant was also to be found in possession of a small quantity of marijuana.

Ann Milliaressis, age 47, residing at 241 North Liberty Drive, Tomkins Cove, pled guilty on March 21, 2012 to Grand Larceny in the 4th Degree. District Attorney, Thomas P. Zugibe stated that on or about August 1, 2009 through May 17, 2011, while the defendant was employed in the cafeteria of a Sloatsburg school located at 11 Second Street in the Village of Sloatsburg, the defendant stole monies. The defendant was the sole person responsible for accepting cash and checks from students for their meals and she was also the sole person responsible for documenting all bank deposits. The defendant was accepting checks from students for their meals, but entering lesser monetary amounts into the computer system and taking the cash difference for herself. Sentencing is scheduled for June 13, 2012 before the Honorable Charles Apotheker, County Court Judge. As part of the defendant’s sentence, she will have to pay $2,000 back in restitution.

Lawrence Payne, age 23, residing at 101 Kennedy Drive, Spring Valley, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crimes of Criminal Mischief in the 3rd and 4th Degree, Criminal Obstruction of Breathing and Blood Circulation and Endangering the Welfare of a Child (2 counts). District Attorney Thomas P. Zugibe stated that on or about February 6, 2012 at approximately 7:50 a.m., the defendant began to assault his mother by throwing her on her bed, caused the bed to break and punched her. The defendant then grabbed his 13-year-old brother by his throat, took his phone and broke it when he attempted to call the police. The defendant then went around the home damaging multiple items in the home. The amount of damage exceeded $250.

Jorge Rivera, age 28 and Mario Immediato, age 23 both residing at 56 Van Orden Avenue, Airmont, were sentenced on March 27, 2012, before New York State County Court Justice William K. Nelson. Rivera received a state prison term of 3 ½ years and 5 years post release supervision and Immediato received 3 ½ years and 3 years post release supervision. Both defendants pled guilty to Burglary in the 2nd Degree. District Attorney, Thomas P. Zugibe stated that on or about April 22, 2011, the defendants burglarized a home located at 85 Route 59 in the Village of Suffern. The defendants stole jewelry, jewelry boxes, stamps, money, various checks, and other documents from the residence. The police were able to recover most of the property taken from the residence.

James Schupner, age 45 residing at 320 Knights Corner, Stony Point, was sentenced on March 27, 2012, before New York State County Court Justice William K. Nelson to a state prison term of 9 years and 5 years post release supervision after pleading guilty to Burglary in the 2nd Degree. District Attorney, Thomas P. Zugibe stated that on or about and between April 18 and May 12, 2011 the defendant burglarized various residences in the Town of Stony Point in which some of the homeowners were present. On or about May 26, 2011 at 9:25 a.m., the Stony Point Police Department and the Rockland County Intelligence Unit had identified the defendant as a suspect in a string of burglaries and began surveillance. Officers followed the defendant from his house, through the county. They observed the defendant parked in the driveway of a residence on South Mountain Road, New City. The officers saw the defendant on the porch with paper in his hands. When police regained visual observation of the house, the front door was opened. The officers approached the house on foot, took the keys out of the defendant’s vehicle and waited for him to exit the home. When the defendant exited, he was immediately arrested and was found to be in possession of several stolen candleholders.

Andrew M. Schwartz, age 53, residing at 969 Park Avenue, New York, pled guilty on March 16, 2012 to Criminal Possession of a Controlled Substance in the 3rd Degree. District Attorney, Thomas P. Zugibe stated that on or about September 29, 2010 at approximately 8 a.m. on the Palisades Interstate Parkway in the Town of Orangetown, subsequent to a Vehicle and Traffic Law Violation stop, the defendant was found to be in possession of thirty 33 grams of cocaine. Sentencing is scheduled for May 25, 2012 before the Honorable Charles Apotheker, County Court Judge.

Elizabeth Slee, age 37, residing at 18 Raffman Road, Bloomingdale, NJ, was charged with one count of Grand Larceny in the Second Degree, a class “C” Felony. The defendant, who worked in the finance department of a Chestnut Ridge company involved in retail shows, is accused of manipulating payroll records of both current and former employees. According to the charges, the defendant diverted additional unearned payroll into personal accounts she set up. The defendant is accused of embezzling over $200,000 from the company during a one-year period. The arrest of the defendant resulted from an investigation conducted by the Ramapo Police Department with assistance from the Rockland County Special Investigations Unit. The defendant was arraigned in the Town of Ramapo Justice Court by the Honorable Schoenberger and remanded to the Rockland County Jail. Bail was set at $75,000 cash or $200,000 bond. The defendant is due to return to court on April 4, 2012. If convicted, the defendant faces 15 years in prison.

Christopher Stanger, age 20, residence unknown, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crimes of Burglary in the 2nd Degree and Criminal Possession of Stolen Property in the 5th Degree. District Attorney Thomas P. Zugibe stated that on or about October 7, 2011 at approximately 8 a.m., the defendant entered a residence in the Village of West Haverstraw and removed jewelry and sold some of the jewelry to a local jewelry store. The jewelry was recovered from the jewelry store.

Anthony Tapia, age 26, residing in Orlando, Florida, pled guilty on March 28, 2012 to Criminal Possession of a Forged Instrument in the 2nd Degree. District Attorney, Thomas P. Zugibe stated that on or about January 16, 2012 at approximately 4:50 p.m., at Macy’s located in the Palisades Center Mall, the defendant used counterfeit 100-dollar bills to pay for a watch valued at $180 and North Face jackets valued at $444. Sentencing is scheduled for May 9, 2012 before the Honorable Charles Apotheker, County Court Judge.

Kristopher J. Thurston, age 27, residing at 7 Charles Lane, Pomona, pled guilty on March 28, 2012 to Driving While Intoxicated as a felony. District Attorney, Thomas P. Zugibe stated that on or about January 14, 2012 at approximately 3:13 p.m. on Slinn Avenue in the Village of Spring Valley, the defendant was found to have been operating a motor vehicle while intoxicated. Sentencing is scheduled for June 13, 2012 before the Honorable Charles Apotheker, County Court Judge.

Shakeal Tyler, age 19, residing at 1750 E. 172nd Street, Bronx, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crimes of Reckless Endangerment in the 1st Degree, Criminal Mischief and Unlawful Fleeing a Police Officer in the 3rd Degree. District Attorney Thomas P. Zugibe stated that on or about March 18, 2012 at approximately 11 p.m., the defendant failed to stop when a NYS Trooper attempted to stop the vehicle driven by the defendant. The defendant drove from Westchester County into Rockland County while being pursued by a NYS Trooper. On Route 303, the defendant crossed the median and drove into oncoming traffic, hit a Trooper vehicle and the defendant lost control and hit a sign and a tree and overturned his vehicle.

Ronald West, age 40, residing at 350 Malcolm X Boulevard, was indicted on March 28, 2012 by a Rockland County Grand Jury for the crime of Criminal Possession of Forged Instrument in the 1st Degree (42 Counts). District Attorney Thomas P. Zugibe stated that on or about July 10, 2011 at approximately 7:13 p.m., the defendant attempted to purchase a MacBook Pro from Best Buy in the Palisades Center Mall with 13 fraudulent $100 bills.
