DA REPORT:

Gwenis Clark, age 47, residing at 21 Tibbits Avenue, White Plains, NY, pled guilty on August 31, 2011 to Criminal Possession of Stolen Property in the 4th Degree. District Attorney, Thomas P. Zugibe stated that on or about June 18, 2011 at approximately 3:36 p.m., the defendant while at 50 Spring Valley Market place in the Village of Spring Valley was found to be in possession of 54 assorted polo shirts worth $1,667.46 which were in the defendant’s motor vehicle.  It was determined that the shirts were stolen from Marshall’s Department Store approximately 1 hour earlier. On October 19, 2011, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to 9 months in the Rockland Country Jail and a $375 mandatory surcharge.

Lawrence Elwell, age 28, residing at 266 East Arlington Road, Arlington, VT, pled guilty on October 19, 2011 to Criminal Possession of Marijuana in the 3rd degree.  District Attorney, Thomas P. Zugibe stated that on or about February 28, 2011 at approximately 3:27 p.m. on I-87 in the Town of Clarkstown, the defendant was found to possess more than 16 ounces of marijuana. Sentencing is scheduled for January 4, 2012 before the Honorable Charles Apotheker, County Court Judge.

Raul Melendez, age 31, residing at 32 Allen Road, Spring Valley, NY, pled guilty on October 19, 2011 to Grand Larceny in the 4th degree. District Attorney, Thomas P. Zugibe stated that on or about and between April 15, 2011 to June 15, 2011 at American Bio Sciences Inc. located at 560 Bradley Parkway #4 in Blauvelt, while the defendant was an employee he took 3 blank checks from the company without permission or authority to do so. The defendant made the checks out to himself in an amount totaling $7,500. Sentencing is scheduled for January 4, 2012 before the Honorable Charles Apotheker, County Court Judge.

Lakeram Singh, age 38, residing at 92 Radford Street, Yonkers, NY, pled guilty to Grand Larceny in the 3rd degree on June 29, 2011. District Attorney, Thomas P. Zugibe stated that on or about and between May 1, 2010 to August 15, 2010 at Pfizer Inc. located at 401 North Middletown Road in Pearl River, the defendant, while employed by The Experts as a data center staffer (computer operator), stole approximately 950 backup tapes from Pfizer Inc. by surreptitiously placing them in a lunch cooler. After the defendant stole the backup tapes he sold them to another company in Hackensack, New Jersey for $45 per tape. On October 12, 2011, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to 5 years probation, 200 hours of community service and a $750 mandatory surcharge and DNA fee. The total amount of Restitution is $93,980.36. This investigation was conducted by the Orangtown Police Department and the case was prosecuted by the Special Investigations Unit of the Rockland County District Attorney’s Office.

 

 

 

Richard Warren, age 44, residing 315 West Main Street, Stony Point, NY, pled guilty on June 15, 2011 to Driving While Intoxicated as a felony. District Attorney, Thomas P. Zugibe stated that on or about December 16, 2010 at approximately 12:27 a.m. on the Palisades Interstate Parkway in the Town of Haverstraw, the defendant was found to have been operating a motor vehicle while intoxicated. On October 19, 2011, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to 1 year in the Rockland County Jail, a 3-year Conditional Discharge, Ignition Interlock Device for 3 years, license revocation for 1 year, $1,000 fine and $520 mandatory surcharge. 

STONY POINT POLICE DEPARTMENT:

Michael J. Azcuy, age 18, residing at 66 Buckingham Court, Pomona, NY, was arrested for Burglary in the 2nd Degree, Grand Larceny in the 4th Degree, Criminal Possession of Stolen Property in the 4th Degree, Criminal Mischief in the 3rd Degree, Criminal Mischief in the 4th Degree, Unlawful Possession of Marijuana, and numerous vehicle and traffic violations. The defendant was arrested following a vehicle and traffic stop where he was found to be in possession of a quantity of marijuana. Further investigation revealed the vehicle the defendant was operating was used in the commission of a residential burglary in the Town of Stony Point. Said residence was burglarized on two separate occasions. This investigation unveiled information that resulted in additional arrests for outstanding cases of car larcenies and criminal mischief’s that have plagued the Town of Stony Point for several months. The defendant was arrested, processed and remanded to the Rockland County Correctional Facility in lieu of $10,000 bail after his arraignment by the Honorable Judge Frank Phillips. The defendant is due back in court on November 3, 2011 at 9 a.m. Additional arrests are pending upon completion of the investigation.

Gary Buigues, age 57, residing at 414 Knights Corner, Stony Point, NY, was arrested for Petit Larceny and Criminal Possession of Stolen Property in the 5th Degree. The defendant was arrested following an investigation into a shoplifting complaint at the ShopRite of Stony Point where he was accused of stealing assorted grocery items and possessing some. The defendant was arrested, processed, and issued an appearance ticket returnable in Stony Point Justice Court on November 17, 2011 at 1:30 p.m.

Erica R. Froeder, age 58, residing at 9 Terry Lane, Stony Point, NY, was arrested following a warrant investigation where it was determined that the defendant did have an active bench warrant issued by the Town of Stony Point for the charge of Petit Larceny. The defendant was arrested, processed, and arraigned before the Honorable Judge William Franks where she was released upon satisfaction of a fine paid in full.

Robert Martinez, age 20, residing at 17 Pierce Drive, Stony Point, NY, was arrested for Unlawful Possession of Marijuana and Criminal Possession of a Controlled Substance in the 7th Degree. The defendant was arrested following a request for assistance at his residence. Officers responding have said the residence found the defendant to be in possession of marijuana and a controlled substance outside its original container. The defendant was arrested, processed, and arraigned before the Honorable Judge Frank Phillips and released on an appearance ticket returnable on November 15, 2011 at 1:30 p.m.

Jonathan Marty, age 22, residing at 16 Wiles Drive, Stony Point, NY, was arrested for Assault in the 2ndDegree. The defendant was arrested after a vehicle and traffic stop revealed that he was the subject of an active arrest warrant for listed charge out of Orangetown. The defendant was arrested, processed, and turned over to the Orangetown Police Department pending arraignment in their jurisdiction.

Sean Maxwell, age 18, residing at 80 Hurd Court, Garnerville, NY, was arrested for Criminal Trespassing in the 3rd Degree, Criminal Mischief in the 4th Degree, and Petit Larceny. The defendant was arrested following an ongoing investigation into property damage and burglaries that occurred at Jaguar Industries and an attempted burglary of Liberty Beer in the Town of Stony Point. This investigation also resulted in additional arrests for outstanding cases of car larcenies and criminal mischief’s that have plagued the Town of Stony Point for several months and is ongoing. The defendant was arrested, processed and released on an appearance ticket returnable on November 17, 2011 at 1:30 p.m.

Michael Reid, age 20, residing at 16 Central Drive, Stony Point, NY, was arrested for Aggravated Unlicensed Operation in the 3rd Degree and numerous vehicle and traffic offenses. The defendant was arrested following a vehicle and traffic stop. Further

DMV inquiry determined that the defendants NYS driver’s license was suspended for failure to pay a fine. The defendant was arrested, processed, and issued numerous summonses with a return court date in Stony Point Justice Court of December 1, 2011 at 9 a.m. and released.

Andrew Scott, age 20, residing at 85 Blauvelt Avenue, West Haverstraw, NY, and Michael T. McNamee, age 20, residing at 39 Eakman Drive, Garnerville, NY, were arrested for Burglary in the 3rd Degree, Criminal Possession of Stolen Property in the 5th Degree, and Petit Larceny. On October 26, 2011, the Stony Point Police Department responded to the area of the Holt Industrial Park in the Town of Stony Point and located the above defendants in possession of copper pipe and aluminum flashing. Further investigation determined that the defendants did enter a building in the above stated complex and cut the copper pipe and were attempting to flee area in possession of the materials when located by responding officers. The responding officers recovered the stolen material and arrested the defendants for listed charges. The defendants were arrested, processed, and arraigned before the Honorable Judge Frank Phillips and remanded to the Rockland County Correctional Facility in lieu of $1,000 bail each. They are to reappear on November 3, 2011 at 9 a.m. in the Stony Point Justice Court.

Azuka Tuke, age 34, residing at 193 Wayne Avenue, Stony Point, NY, was arrested for Aggravated Unlicensed Operation in the 3rd Degree, Operating with Suspended Registration and numerous vehicle and traffic offenses. The defendant was arrested after the vehicle he was operating was involved in a one-car accident and an accident investigation revealed that he was operating a motor vehicle while his NYS driver’s license was suspended and the registration of the vehicle he was operating was also suspended. The defendant was arrested, processed, and issued an appearance ticket with a return court date in Stony Point Justice Court of November 17, 2011 at 1:30 p.m. after posting $60 bail.

 

 
An unnamed male, age 18, residence unknown, was arrested for Rape in the first Degree. The defendant was arrested on October 12, 2011, following an investigation of a sexual assault involving a 3-year-old victim. The defendant was arrested, processed, and arraigned in the Rockland County Family Court and placed in a secure facility pending further court orders.

An unnamed male, age 17, residence unknown, was arrested for Criminal Possession of Stolen Property in the 5th Degree and Petit Larceny. The defendant was arrested following an ongoing theft and vandalism investigation at Jaguar Industries in the Town of Stony Point and other areas within the town. This investigation also unveiled information that resulted in additional arrests for outstanding cases of car larcenies and criminal mischief’s that have plagued the Town of Stony Point for several months. The defendant was arrested, processed, and released on an appearance ticket returnable on November 3, 2011 at 9 a.m. Additional arrests are pending upon completion of the investigation.

An unnamed male, age 17, residence unknown, was arrested for Criminal Possession of Stolen Property in the 4th Degree and Criminal Mischief in the 3rd Degree. The defendant was arrested following a residential burglary investigation in the Town of Stony Point. The said residence was burglarized on two separate occasions. Proceeds from the burglary were located at the defendant’s residence. This investigation also unveiled information that resulted in additional arrests for outstanding cases of car larcenies and criminal mischief’s that have plagued the Town of Stony Point for several months. The defendant was arrested, processed and arraigned before the Honorable Judge William F. Franks and released on an appearance ticket for a future court appearance. Additional arrests are pending upon completion of the investigation.

Two unnamed males, ages 17, residences unknown, were arrested for Burglary in the 2nd Degree, Grand Larceny in the 4th Degree, Criminal Possession of Stolen Property in the 4th Degree, Criminal Mischief in the 3rd Degree, and Criminal Mischief in the 4th Degree. The defendants were arrested following an investigation of a residential burglary in the Town of Stony Point. The said residence was burglarized on two separate occasions. This investigation unveiled information that resulted in additional arrests for outstanding cases of car larcenies and criminal mischief’s that have plagued the Town of Stony Point for several months. The defendants were arrested, processed, and released on appearance tickets returnable before the Honorable Judge William F. Franks at a future date. Additional arrests are pending upon completion of the investigation.
