Fraud Arrest

Nena Tavarez-DiazOn Monday, July 28, 2014 at approximately 7:45 p.m., the Clarkstown Police Department responded to a report of possible fraud at Lord and Taylor, located at the Palisades Center Mall. Loss prevention employees were monitoring two male suspects using a credit card to purchase store gift cards and it was determined that a credit card being used was fraudulent.

The suspects were followed to a vehicle parked outside the store. A female suspect entered the car at the same time as the two male suspects. The suspect vehicle was stopped a short distance from the mall. A male and female suspect were taken into custody and the other male ran from the scene and was not apprehended. Franklin Tavarez-Diaz, 29, of New York, NY and Rossilia Nena, 25, of the Bronx, were arrested and transported to police headquarters for processing. The third suspect was described as a male Hispanic, 30, wearing a blue shirt, jeans and a white ball cap. The suspects were in possession of merchandise valued at $4,400.

The merchandise consisted of gift cards and clothing. The defendants were charged with criminal possession of forged instrument in the second degree (felony), criminal possession of stolen property in the third degree (felony), and grand larceny in the third degree (felony). Tavarez-Diaz and Nena were arraigned in Clarkstown Justice Court. Bail was set at $5,000 for each suspect. They were transported to the Rockland County Jail and due to return to court on August 1, 2014 at 9:30 a.m.
