DA REPORT:
Orlando L. Alvarado, age 21, residing at 18A Kensington Circle, Garnerville, NY, pled guilty on October 28, 2011 to Grand Larceny in the 4th Degree. District Attorney, Thomas P. Zugibe stated that on or about February 2011 to June 2011 at Radio Shack located at 4120 Palisades Center Drive in West Nyack, the defendant, while an employee of the store, fraudulently generated false return transactions. The defendant entered merchandise returns into the store register while not actually receiving any property from customers. The defendant then produced store credit gift cards from the false transactions and took possession of them for personal use. The defendant stole approximately $13,370 from Radio Shack. Sentencing is scheduled for January 6, 2012 before the Honorable Charles Apotheker, County Court Judge.

Alisha Batista, age 27, residence known, was arrested at 200 North Main Street, Spring Valley, on a Family Court warrant on October 26, 2011. The defendant was ROR’d with a return date of November 4, 2011 at 2 p.m.

Bhavesh Desai, age 40, residing at 32 Phillips Road, Edison, NJ, was convicted on November 2, 2011 after a jury trial of one count of Petit Larceny, and one count of Criminal Possession of Stolen Property in the 5th Degree, both class “A” misdemeanors. On October 27, 2010, at approximately 2:00 p.m., the defendant, who worked as a contractor at LeCroy. Corporation in Chestnut Ridge, stole an I-Pad belonging to a physician who was attending a company-wide meeting at the location. Upon returning to his office, the victim noticed the new tablet computer had vanished from his desk and alerted fellow LeCroy staff members. A subsequent investigation including key-card records showed Desai exiting the building at 2:13 p.m. and returning at 2:21 p.m.  Surveillance video of the exit showed defendant concealing a rectangular item under his sweater that he held with one of his hands. A Ramapo police search of the defendant’s car in the rear parking lot of LeCroy uncovered the I-Pad secreted beneath the floor mat of the passenger side. The defendant’s trial began on October 18, 2011. Jurors deciding the case on October 25 returned a verdict of guilty on both counts. The defendant remains free on bail pending sentencing on January 18, 2012.

Alfredo Godinez, age 40, residing at 709 Route 9W, Valley Cottage, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Driving While Intoxicated as a Felony and Aggravated Unlicensed Operation of a Motor Vehicle in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about June 5, 2011 at approximately 5 a.m., the defendant was stopped for various vehicle and traffic violations while driving on Route 9W in the Village of Haverstraw. The defendant admitted to drinking and submitted to three sobriety tests and a breathalyzer test which revealed a blood alcohol content of .24%. The defendant had a suspended license due to a DWI conviction in 2003.

Jose Gonzalez, Age 22, residing at 93 Lakeview Village, Spring Valley, NY, was sentenced November 14, 2011, before New York State Acting Supreme Court Justice William K. Nelson to a state prison term of 3 ½ years and 5 years post release supervision after pleading guilty to Robbery in the 2nd Degree. District Attorney, Thomas P. Zugibe stated that on or about on or about February 5, 2011, in the Lakeview Village Apartment, Spring Valley, the defendant displayed a handgun to the victim and demanded his money and his cell phone. The defendant took the victim’s cell phone and money and ran off. After further investigation by the Spring Valley Police Department, the defendant was located and arrested and found to be in possession of the victim’s cell phone and money.

Barbara Harper, age 41, residing in Brooklyn, NY, was arrested on October 18, 2011 in Clarkstown on a warrant for Welfare Fraud in the 3rd Degree. The defendant was arraigned by Honorable Judge Stein and remanded to the Rockland County Jail on $3,000 bail with a return court date of October 27, 2011.

Juan Hernandez, also known as Juan Pablo, age 28, residing at 67 Hudson Avenue, Haverstraw, NY,was sentenced on November 9, 2011, before New York State Supreme Court Justice William A. Kelly to a state prison term of 4 ½ years and 3 years post release supervision after pleading guilty to Attempted Criminal Sale of Controlled Substance in the 3rd Degree. District Attorney Thomas P. Zugibe stated that on or about and between January 14 and January 29, 2010, the defendant sold cocaine to another individual on two occasions. One sale was in the amount of $190 and another $760 USC.

Joseph Hicks, age 41, residing at 24 West Street, Haverstraw, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes Burglary in the 1st Degree and Escape in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about October 14, 2011 in the Village of Haverstraw, the defendant entered a dwelling located at 49 New Main Street, Haverstraw, New York while armed with a gravity knife and stole property. After being placed under arrest, the defendant broke the window of a police cruiser and escaped from police custody.

Rafael N. Huertas, age 20, residing at 300 Morris Avenue, Bronx, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Grand Larceny in the 4th Degree, Criminal Possession of Stolen Property in the 4th Degree, Criminal Mischief in the 3rd Degree, Unlawful Fleeing a Police Officer in a Motor Vehicle in the 3rd Degree, Resisting Arrest, Obstructing Governmental Administration in the 2nd Degree, and Reckless Driving. District Attorney Thomas P. Zugibe stated that on or about September 19, 2011 at approximately 5:30 a.m., the victim reported his vehicle stolen from 110 Gurnee Avenue in the Village of Haverstraw. At approximately 4 a.m., an officer from the Sheriff’s department was pursing the same vehicle for failure to stop at a red light while driving south on Route 303. After a chase, the defendant was apprehended and placed under arrest. The officer then learned that the vehicle was stolen.

Brenda Hughes (AKA Tawanda Green), age 48, residing at 25 Van Cortlandt Park Avenue, Yonkers, NY, pled guilty on August 19, 2011 to Criminal Possession of Stolen Property in the 4th Degree. District Attorney, Thomas P. Zugibe stated that on or about June 18, 2011 at approximately 3:36 p.m., the defendant while at 50 Spring Valley Market place in the Village of Spring Valley was found to be in possession of 54 assorted polo shirts worth $1,667.46, which were in co-defendant Gwenis Clark’s motor vehicle.  It was determined that the shirts were stolen from Marshall’s Department Store approximately 1 hour earlier. On October 28, 2011, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to 1 ½ to 3 years in State Prison.

Caroline E. Keith, age 48, 16 East Catherine Street, Nyack, NY, pled guilty on October 26, 2011 to Grand Larceny in the 4th Degree. District Attorney, Thomas P. Zugibe stated that on or about July 10, 2010 in Upper Nyack, the defendant stole two checkbooks from the victim’s desk drawer. Thereafter, the defendant forged and cashed numerous checks totaling $22,672.97 between July 10, 2010 and June 15, 2011. Sentencing is scheduled for January 11, 2012 before the Honorable Charles Apotheker, County Court Judge.

Mainor Lemus-Beza, age 26, residing at 66 Second Avenue, Basement Apartment, Nanuet, NY, was indicted on November 2, 2011 by a Rockland County Grand Jury for the crime of Rape in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about October 13, 2011 at approximately 4:00 a.m., the defendant forced a woman known to him into his apartment and forcibly raped her.

Raymond Lewis, age 52, residing at 480 East 188th Street, Bronx, NY, was sentenced November 1, 2011, before New York State Supreme Court Justice William A. Kelly to a state prison term of 7 years and 5 years post release supervision after pleading guilty to Robbery in the 2nd Degree. District Attorney Thomas P. Zugibe stated that on or about December 22, 2010, at approximately 8:25 p.m., the defendant was observed by Macy’s Loss Prevention taking fragrances, placing them into a bag, and passing all points of purchase. When the defendant was confronted by Macy’s Loss Prevention, he became combative, and reached into his jacket and stated, “I have a gun, don’t make me pull my gun on you.” When police arrived on scene, the defendant reached into his waistband as if to draw a firearm. The defendant was placed under arrest.

Segundo Loja-Llivicota, age 25, residing at 25 Lafayette Street, Spring Valley, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crime of Assault in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about August 23, 2011, the defendant approached the victim in the basement of 25 North Madison Avenue in the Village of Spring Valley. The defendant attacked the victim with a knife, causing the victim to suffer knife wounds to his left arm, chest, face and head. The victim was taken to Nyack Hospital to be treated for multiple injuries.

James Mann, age 42, residence unknown, was arrested at residing at 1 South Main Street, New City, NY on a Family Court Warrant on October 26, 2011. The defendant was ROR’d with a return court date of November 23, 2011 at 9 a.m.

Terrence Maurice, age 22, residing at 101 Cedar Hill Ave, South Nyack, NY
, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Grand Larceny in the 4th Degree and  Criminal Possession of Stolen Property in the 4th Degree. District Attorney Thomas P. Zugibe stated that on or about February 12, 2011, the victim left his wallet at Palmieri Wine located in the Village of Nyack. The defendant picked up the wallet and left the store. The victim realized that he left his wallet and went back to the store but the store was closed. While walking home he encountered the defendant and defendant handed him the wallet and said, “Here’s your wallet.” The victim realized the following day that his credit card was missing and contacts the Orangetown Police Department.

Prince Nelson, age 27, residing at 18 Campbell Court, West Haverstraw, NY, was sentenced November 9, 2011, before New York State Supreme Court Justice William A. Kelly to a state prison term of 2 years and 2 years post release supervision after pleading guilty to Attempted Criminal Sale of Controlled Substance in the 5th Degree. District Attorney Thomas P. Zugibe stated that on or about September 20, 2010, the defendant sold 10 Adderall pills (stimulant/narcotic drug) to another individual for $60 USC. In addition, on October 18, 2010, the defendant sold another individual 19 Klonopin pills (depressant/narcotic drug) for $60 USC.
Pedro Ortega-Salazar, age 40, residing at 46 Lafayette Street, Spring Valley, NY, was sentenced November 9, 2011, before New York State Supreme Court Justice William A. Kelly to a state prison term of 1 to 3 years after pleading guilty to Sexual Abuse in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about March 12, 2011, the defendant touched the genital areas of a 9-year-old girl with whom he is related.

Luis Ramos, age 29, residing in Shrub Oak, NY, was arrested on October 17, 2011 in New York, NY on an outstanding warrant for Attempted Rape in the 2nd Degree from Rockland County Court. He was lodged in the Rockland County Jail awaiting arraignment in county court.

Edwin Raoul, age 23, residing at 250 North Main Street, Apt. F33, Spring Valley, NY, Woody Temora, age 23, residing at 268 North Main Street, Apt. 1D, Spring Valley, NY, Rashard Buckley, age 24, residing at 3 East Hickory Street, Spring Valley, NY, and Darvel Davenport, age 24, residing at 5 Hickory Street, Spring Valley, NY, were indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes Robbery in the 2nd Degree (2 counts) and Defendant Rashard Buckley was also indicted for Reckless Endangerment in the 1st Degree. District Attorney Thomas P. Zugibe stated that on or about October 18, 2011 at approximately 2:40 p.m. at 110 Union Road located in the Village of Spring Valley, defendants Raoul, Temora and Davenoport robbed another person of $1,900 in cash. The defendants fled to defendant Buckley’s vehicle, which was parked on Union Road. Defendant Raoul was unable to reach the vehicle and was instantly placed under arrest. As Buckley fled the area, he drove at high rates of speed throughout the Village of Spring Valley. During the flight from police, defendant Buckley drove his vehicle in between two school buses full of children and caused damage to his vehicle and the two buses. The vehicle was later abandoned by all three defendants who fled the area. Defendant Temora was arrested shortly thereafter and was found to be in possession of the stolen money. Defendant Buckley surrendered to the police on October 20, 2011 and Davenport was located and arrested on October 22, 2011.

Steve Raymond, age 37, 11 Samsondale Avenue, West Haverstraw, NY, the defendant was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes Criminal Possession of Marijuana in the 2nd Degree and Unlawful Possession of Marijuana. District Attorney Thomas P. Zugibe stated that on or about June 17, 2011 at approximately 2:30 p.m., at 11 Samsondale Avenue in the Village of West Haverstraw, the defendant was found to be in possession of more than 16 ounces of marijuana.

James Scott, age 40, 64 Burnside Avenue, Congers, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Reckless Endangerment in the 1st Degree, Aggravated Unlicensed Operation in the 1st Degree, Driving While Intoxicated, Resisting Arrest, Unlawfully Fleeing a Police Officer in a Motor Vehicle in the 3rd Degree and Reckless Driving. District Attorney Thomas P. Zugibe stated that on or about October 18, 2011 at approximately 7:15 p.m. an officer of the Clarkstown Police Department observed the defendant driving his vehicle on Route 9W at a high rate of speed. The officer attempted stop the defendant by activating his lights and sirens, the defendant turned off all the vehicle lights and led the officer on a high-speed chase. The defendant drove through stop signs, through a red traffic light, drove in the opposite lane of traffic- causing vehicles to stop in the road or swerve to avoid a collision among other traffic violations. After defendant stopped the car, he got out and ran away from the police officer and resisted arrest. The officer smelled odor of alcohol coming from defendant’s breath at the time of the arrest. The defendant’s license was suspended for unanswered traffic tickets.

Frank Segreto, age 21, residing at 6 Gary Place, Wanaque, NJ, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Arson in the 3rd Degree (3 counts), Arson in the 4th and 5th Degree, Criminal Mischief in the 2nd Degree (4 counts) and Criminal Mischief in the 3rd Degree. District Attorney Thomas P. Zugibe stated that on or about September 25, 2011 at approximately 5:38 a.m., the defendant set fire to a boat and four trucks at 103 Sterling Mine Road in the Village of Sloatsburg. The fire spread from the boat to a building causing damage to the building.

Sean F. Smith, age 41, residing at 55 Sheridan Avenue, Mount Vernon, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes of Robbery in the 3rd Degree and Grand Larceny in the 4th Degree. District Attorney Thomas P. Zugibe stated that on or about November 14, 2011, at approximately 4 p.m., the defendant was observed in Home Depot located in the Palisades Center Mall in the Village of Nyack with a shopping cart with merchandise inside and walked out without paying for the items. The defendant was apprehended in the parking lot by the Home Depot Investigator and two Clarkstown Police Officers.

Krista Soltys, age 18, residing at 14 Center Street, Clifton, NJ, was indicted on November 2, 2011 by a Rockland County Grand Jury for the crimes of Criminal Possession of a Controlled Substance in the 3rd & 4th Degree and Unlawful Possession of Marijuana. District Attorney Thomas P. Zugibe stated that on or about October 24, 2011 at approximately 9:00 p.m. on the Palisades Parkway, Town of Clarkstown, the vehicle the defendant was a passenger in was stopped for numerous vehicle and traffic violations. After a search of the vehicle, the defendant was found to be in possession of approximately 12 grams of cocaine and three grams of marijuana.

Patricia Teixeira, age 56, residing at 4 New Street Middletown, NY, was indicted on November 9, 2011 by a Rockland County Grand Jury for the crimes Criminal Possession of a Controlled Substance in the 3rd & 4th Degree. District Attorney Thomas P. Zugibe stated that on or about June 21, 2011 at approximately 12 p.m., on the Palisades Parkway in the Town of Clarkstown, the vehicle the defendant was a passenger in was stopped for numerous vehicle and traffic violations. Neither of the occupants of the vehicle was licensed to drive in New York State. After a search of the vehicle and defendant, the defendant was found to be in possession of one 136 decks of heroin.

Alexander Waldman, age 20, residing at 27 Old Mill Road, West Nyack, NY, was arrested after he turned himself in on a Bench Warrant issued for Attempted Criminal Possession of a Controlled Substance in the 3rd Degree. On October 25, 2011, the defendant turned himself in to the Sheriff’s Department for the listed charges by Judge Apotheker of Rockland County Court. The subject was turned over to the county jail and will be arraigned on October 26, 2011.

STONY POINT POLICE DEPARTMENT:

Tyquan J. Berry, age 26, residing at 247 Washington Street, Newburgh, NY, was arrested was arrested after being stopped for a vehicle and traffic offense and NYS DMV inquiry that determined defendant was operating a motor vehicle while his license was suspended and the registration of the vehicle he was operating was suspended. The defendant did also have an active Arrest Warrant for operating a motor vehicle with a suspended registration out of the City of Newburgh. Defendant was arrested for Aggravated Unlicensed Operation 2nd and Operating with a Suspended Registration and other vehicle and traffic offenses.  The defendant was processed, and released to the City of Newburgh Police Department after being issued numerous traffic tickets with a return court date of December 1, 2011 at 1:30 p.m. in the Stony Point Justice Court.

Luvenson O. Charles, age 20, residing at 15 Marion Court, Pomona, NY, was arrested for Aggravated Unlicensed Operation in the 3rd Degree and numerous vehicle and traffic infractions. On October 31, 2011, the defendant was arrested after being stopped for a vehicle and traffic offense and NYS DMV inquiry that determined defendant was operating a motor vehicle while his license was suspended. The defendant was processed and released after being issued numerous traffic tickets with a return court date of November 15, 2011 at 1:30 p.m. in the Stony Point Justice Court.

Janel L. Dapra, age 27, residing at 18 Kaplan Way, Highlands, NY
, was arrested on November 7, 2011 for Petit Larceny and Criminal Possession of Stolen Property in the 5th Degree following an investigation into a shoplifting complaint at the ShopRite of Stony Point where she is accused of stealing assorted grocery items, and possessing same. The defendant was arrested, processed, and issued an appearance ticket returnable in Stony Point Justice Court on December 13, 2011 1:30 p.m. after posting $100 bail.

Nick G. Girault, age 33, residing at 73 Springbrook Lane, Nanuet, NY, was arrested for Aggravated Unlicensed Operation in the 3rd Degree and numerous vehicle and traffic infractions. The defendant was arrested after being stopped for a vehicle and traffic offense and NYS DMV inquiry that determined defendant was operating a motor vehicle while his license was suspended. Defendant was arrested for Aggravated Unlicensed Operation 3rd. The defendant was processed, and released after being issued numerous traffic tickets with a return court date of December 1, 2011 at 9 a.m. in the Stony Point Justice Court.

Daryl K. Griffin, age 51, residing at 29 Farley Drive, Stony Point NY, was arrested for DWI, AUO in the 3rdDegree, and Unlicensed Operation. Stony Point Police arrested the defendant following an investigation of a one car motor vehicle accident in which defendant was injured. Subsequent investigation determined that the defendant did operate a motor vehicle while in an intoxicated condition. The defendant was arrested, and transported to Nyack Hospital where he was processed, and issued an appearance ticket with a return court date of December 1, 2011 at 9 a.m. before the Honorable Judge Frank Phillips.

Tammy Hansen, age 33, residing at 364 North Liberty Drive, Tomkins Cove, NY, was arrested on an outstanding warrant for DWI. The defendant was arrested after she turned herself in on active Bench Warrant. The defendant was arrested, processed, and arraigned before the Honorable William F. Franks. The defendant was then released on an appearance ticket after posting $200 cash bail and is due to return on December 15, 2011 at 1:30 p.m. in the Stony Point Justice Court.

Elizabeth Stith, age 22, residing at 200 Dashew Drive, Apartment H7, Suffern, NY, was arrested for Aggravated Unlicensed Operation in the 2nd Degree and numerous vehicle and traffic infractions. On October 31, 2011 the defendant was arrested after being stopped for a vehicle and traffic offense and NYS DMV inquiry that determined defendant was operating a motor vehicle while his license was suspended. The defendant was processed, and released after being issued numerous traffic tickets with a return court date of December 1, 2011 at 9 a.m. in the Stony Point Justice Court.

An unnamed male, age 17, residence unknown, was arrested for Criminal Mischief in the 4th Degree. The defendant was arrested following the ongoing theft and vandalism investigation at Jaguar Industries in the Town of Stony Point. The defendant was arrested, processed, and released on an appearance ticket returnable on December 1, 2011 at 9 a.m. Additional arrests are expected upon completion of the investigation.
